This Privacy Policy (“Policy”) explains how Technology Insurance Company, Inc., a Canadian branch, (“TIC”, the “Company”, “we”, “us” or “our”) operating within Canada collects, uses, discloses, maintains and protects Personal Information when a user (“user” or “you”);

  • uses or accesses our website - https://ticcanada.ca (the “Site”); 
  • provides Personal Information through the administration of insurance policies and other services that we may provide you (“Services”);
  • interacts with us or our representatives, in the course of our Services;
  • purchases third party products to which we offer our Services and insurance products.

We may change the provisions of this Policy at any time and for any reason in our sole and absolute discretion and will indicate when changes have been made by revising the date at the top of this Policy and on this Site. All changes are effective immediately when posted. By using this Site, you consent to the terms and conditions provided in this Policy, and the continued use following the posting of such changes shall constitute your consent to such changes. We encourage you to review this Policy whenever you access the Site to see if it has changed and make sure that you understand the most current information about your privacy.
 

Personal Information. TIC is committed to protecting the privacy of the Personal Information of individuals we collect in conducting our business. Our goal is to provide excellent service while meeting our commitment to keep your Personal Information safe and secure. The safeguards we use to protect your Personal Information are described below.

Personal Information,” to the extent collected, is information that identifies or relates to you, or is capable, directly or indirectly, by itself or in combination with other information, of identifying an individual.

Links to Third-Party sites. This Policy does not apply to any activity on third-party websites and mobile applications that may link to our Site. Our Site may contain links to other websites or platforms; those websites operate independently from us, and their privacy practices are subject to their own privacy policy or policies, which we strongly encourage you to review to understand their procedures for collecting, using and disclosing Personal Information. We are not responsible for the content of the linked websites, any use of these websites, or the privacy practices of these websites. We do not control third-party websites and applications and are not responsible for their actions or privacy practices.
 

WHAT INFORMATION DOES TIC COLLECT?

TIC collects information: (1) directly from you; (2) automatically, through your use or access to the Site; and (3) from third parties in connection with your use of the Site and in providing Services to you.

 

1) Information that you provide 

TIC collects information that you provide when you use or access the Site. This information collection may occur, for example, when you: (a) submit an application, quote, or a claim or fill out any forms on the Site; (b) create an online account or register to use the Services; (c) make a payment related to your insurance policy; (d) send questions or comments via email, text messaging or live chat to customer support; (e) fill out online surveys; and (f) otherwise communicate or interact with us through the Site.

2) Information we collect automatically

When you interact with our Site, we may collect technical information associated with the device you use, such as the type and model, system language, browser type, geographical location and operating system, your Internet protocol (IP) address, IDFA (identifier for advertisers) and other unique identifiers. We may also process information about what you do on our Site, such as how long you visit, what links you click on, what pages you visit, how many times you visit a page and how long it takes for you to come back.

We may utilize tools provided by third parties on our Site to help us understand how users access and use the Site, such as Google Analytics. TIC may receive Personal Information about you from other individuals, companies or third parties or third parties acting on your instructions, partners who work with us to provide our insurance products and Services and help us to guarantee security and prevent fraud, and from other lawful sources.
 

HOW DOES TIC USE THE INFORMATION IT COLLECTS?

We may use the information including Personal Information that we collect or you provide as described in this Policy for the following purposes:

  • Provide and deliver the Services you request, process transactions, and to send you related information, including expiration and renewal notices, confirmations and invoices;
  • Providing insurance, handling claims and any other related purposes. This may include underwriting decisions made via automated means;
  • Provide you with quotes for requested insurance products;
  • To notify you about changes to our Service;
  • Send you advertising or promotional materials, including information about new products, contests, features and enhancements, special offers and other events of interest from TIC and our select partners;
  • Respond to your comments, questions and requests;
  • Present this Site and its contents to you;
  • Improve the Site, Services and overall customer experience;
  • Monitor and evaluate trends, usage and activities in connection with our Site and the Services;
  • Monitor performance and usage of the Services, identify problem areas with the Services, and inform design development and updates;

WITH WHOM DOES TIC SHARE YOUR INFORMATION?

We may share your information that we collect from and about you described in this Policy. In particular, we may disclose Personal Information that we collect or you provide as described below:

  • TIC may require the services of third-party vendors, consultants and other service providers who are working on our behalf to provide the Services or the Site. These include the processing of Personal Information in connection with your use of our Services or insurance products;  
  • TIC may communicate Personal Information with our group companies, affinity partners, brokers, agents, third-party administrators, loss adjusters, reinsurers, and other insurance intermediaries as needed to provide you with insurance products and Services that you request;
  • When TIC requires professional advice, we may require the services of third party advisors, such as solicitors, barristers or accountants, who may handle your Personal Information as needed;
  • It may be necessary for TIC to share Personal information to enforce our agreements, policies and terms of use, to protect against fraudulent, abusive, inappropriate, or unlawful use of the Site or our Services. In such cases, Personal Information may be communicated to other entities such as entities to protect the rights, safety and property of TIC, our employees, agents, users, fraud detection agencies and other third parties;
  • In accordance with applicable laws, we may communicate Personal Information to third parties or affiliates in connection with a corporate transaction, such as a sale, consolidation or merger of TIC’s business;
  • In some circumstances, we may communicate Personal Information to governmental authorities and third parties to comply with legal requirements, such as, demands, subpoenas, court orders, and other legal processes; and
  • We may communicate Personal Information to any entity and for any other purpose disclosed by us with your consent.

Some of these third parties may be located outside of Canada, meaning that your Personal Information may be transferred to countries outside of Canada. Similarly, if you are located in Québec, some of your personal data may be communicated outside of Québec. Accordingly, your Personal Information may be accessible to foreign courts, law enforcement and national security entities. TIC is an affiliated company of AmTrust Financial Services, Inc. The Personal Information we collect may be used, communicated, stored and processed by AmTrust Financial Services, Inc., in Canada and the United States and other countries, including but not limited to the United Kingdom, Italy, Germany, and Bermuda and may be transferred outside of your jurisdiction, as the case may be. Please note that your Personal Information may be subject to the laws of general application in the jurisdiction where it is stored, including lawful access. YOUR RIGHTS 

We strive to provide you with choices regarding the Personal Information you provide. The following mechanisms are available:


A. Regarding Personal Information 
  • Right of access and rectification. You may request access to and obtain a copy of any of your Personal Information that we hold and request correction of any inaccurate, outdated or incomplete information related to you or deletion of your Personal Information under certain circumstances. You also have the right to request information on the types of Personal Information that are being collected and how these are processed.

  • Right to opt-out. Subject to certain exceptions, you may “opt-out” or withdraw your consent at any time to the collection, use, disclosure or any other form of processing of your Personal Information. Please note that if you withdraw your consent to some processing of your Personal Information, we may not be able to provide you with a particular product or service.

  • Right to data portability. If you are a resident of Quebec, you also have the right to receive computerized Personal Information collected in a structured, commonly used and technological format and to have this information transferred directly to any person or body authorized by law to collect such information. 

We will acknowledge all requests as soon as reasonably practicable, and in any event within thirty (30) days. In most cases we cannot delete your Personal Information except by also deleting your user account.

To exercise your rights, please:

We will need to verify your identity before processing most requests. Please provide your name, email address and mailing address in the original request, as well as an explanation of the rights you wish to exercise. We will only use the information provided via the foregoing to review and comply with the request. If you do not provide this information, we may not be able to verify or complete your request in all circumstances.

If you wish to submit a verifiable consumer request on behalf of another individual, such as a minor child, we will also need sufficient information to verify that the individual is the person about whom we collected personal information and that you are authorized to submit the request on their behalf.

In certain circumstances, such as for legitimate organizational interests or a valid legal requirement, we may decline a request to exercise the rights described above. If we deny your request in whole or in part, we will provide you with several pieces of information describing the reasons of our denial.


B. Regarding Cookies and Other Collection Technologies

Finally, you may opt-out of TIC sharing your data with affiliates for marketing purposes. If you opt out, we may still send you transactional or relationship messages, such as emails about your account or our ongoing business relations, for furtherance of any legitimate business purpose.


HOW DOES TIC SAFEGUARD YOUR PERSONAL INFORMATION?

TIC maintains reasonable and appropriate security measures designed to protect your Personal Information. We take the security of Personal Information seriously. TIC will protect your Personal Information with safeguards commensurate with the sensitivity of the information. TIC has established reasonable technical, physical, legal and organizational measures which are consistent with applicable privacy and data security laws and our organizational requirements.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee security. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures. While we seek to keep information safe and secure, we cannot and do not guarantee that personal information you provide to us will be secure, or that the Services will be uninterrupted or error-free.


DATA RETENTION 

We will only retain your Personal Information for as long as necessary to fulfill the purposes for which we collected it or meeting any legal or regulatory requirements. Your Personal Information will not be retained for longer than is necessary, unless we are required to retain the Personal Information for a longer period due to business, legal or regulatory requirements.


CHILDREN UNDER THE AGE OF FOURTEEN

TIC’s Site and Services are not intended for children under fourteen (14) years of age. No one under the age of fourteen (14) may provide any Personal Information to TIC in connection or in association with the Services. We do not knowingly collect Personal Information from children under fourteen (14).
